Off-Plan Distress Resales in Dubai: How to Buy Below Launch Price Safely

How an off-plan distress resale works

  1. Agree a price with the seller — usually expressed as the amount you pay them, on top of the remaining developer instalments.
  2. Confirm resale eligibility — the developer must allow assignment, which often requires a minimum percentage of the price to have been paid.
  3. Clear outstanding dues and get the developer's NOC.
  4. Transfer the contract (Oqood in Dubai) to your name at the DLD or a trustee office.
  5. Continue the payment plan with the developer through to handover.

Why off-plan sellers get distressed

  • They bought several units at launch and can't fund all the instalments
  • Their personal finances changed before handover
  • They planned to flip before completion and the timeline slipped
  • They need the money they've already paid out of the project

What to check

  • Paid vs remaining: exactly how much has been paid and when each future instalment is due
  • Construction progress: compare the developer's stated progress with what's on site
  • Handover date risk: delays mean you fund instalments longer before you can rent or sell
  • Developer track record: delivery history on previous projects
  • Mortgage options: off-plan financing is limited before completion, so plan to pay instalments in cash until handover

Frequently asked questions

Is buying an off-plan resale in Dubai safe?

It can be, when the transfer goes through the developer and DLD and you verify the paid amount, remaining plan and the developer's NOC. The main risks are construction delays and developer delivery.

Do I pay DLD fees on an off-plan resale?

Yes. The DLD transfer fee applies to off-plan resales, and the developer will usually charge an NOC or admin fee. Confirm the exact amounts before signing.

Can I get a mortgage on an off-plan resale?

Financing before completion is limited and depends on the bank and project. Most buyers fund the remaining instalments in cash until handover, then mortgage if needed.
